IMPORTANT: Please read these Terms of Service carefully before using GoClaim Agent. By accessing or using our service, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing, downloading, installing, or using GoClaim Agent ("the Service," "the Application," or "the Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User," "Client," or "you") and GoClaim Agent ("Company," "we," "us," or "our").

If you do not agree to these Terms, you must not use the Service. Your continued use of the Service after any modifications to these Terms constitutes your acceptance of such changes.

2. Description of Service

GoClaim Agent is an AI-powered debt collection platform that automates and streamlines debt recovery processes. Our service provides:

  • Automated Debt Collection: AI-driven collection workflows and communications
  • Payment Processing: Secure payment handling and transaction management
  • Debtor Management: Comprehensive debtor database and tracking system
  • Reporting and Analytics: Collection performance insights and reporting tools
  • Communication Management: Automated and compliant debtor communications

3. Eligibility and Registration

3.1 User Eligibility

To use GoClaim Agent, you must:

  • Be at least 18 years of age or of legal age in your jurisdiction
  • Have the legal authority to enter into binding agreements
  • Be a legitimate business entity or individual engaged in lawful debt collection activities
  • Comply with all applicable local, state, federal, and international laws

3.2 Account Registration

You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use Policy

4.1 Permitted Uses

You may use GoClaim Agent only for lawful debt-collection activities in accordance with applicable laws, including but not limited to the:

  • French Civil Code (Code civil) (e.g. Articles 1244-1 et seq. on enforcement measures and accelerated procedures)
  • French Commercial Code (Code de commerce) (Articles L 441-6 et seq. on late-payment interest and recovery costs)
  • Law No. 2008-776 of 4 August 2008 on the Modernisation of the Economy (Loi LME), setting maximum payment terms for B2B transactions in France
  • Law No. 2010-1249 of 29 October 2010 (and Decree No. 2012-1110 of 2 October 2012) regulating professional debt-collection agencies in France
  • Directive 2011/7/EU of 16 February 2011 on combating late payment in commercial transactions across the EU Eur-Lex
  • Regulation (EU) 2016/679 (GDPR) concerning the processing of personal data in debt-collection contexts

and any other local statutes or regulations applicable in the jurisdictions where you deploy GoClaim Agent. Failure to comply with these provisions (and their national implementing measures) may result in suspension or termination of your access.

4.2 Prohibited Uses

You agree not to use the Service to:

  • Engage in harassment, abuse, or threats toward debtors
  • Collect debts that are not legally valid or enforceable
  • Violate any applicable debt collection laws or regulations
  • Impersonate any person or entity or misrepresent your affiliation
  • Transmit malicious code, viruses, or harmful software
  • Interfere with or disrupt the Service or its servers
  • Attempt to gain unauthorized access to the Service or user accounts
  • Use the Service for any illegal or unauthorized purpose

5. Data Protection and Privacy

We implement industry-standard security measures to protect your data and debtor information. However, no system is completely secure, and you acknowledge the inherent risks of data transmission and storage. For more details, please see our Privacy Policy.

6. Payment Terms

6.1 Subscription Fees

Access to GoClaim Agent requires payment of applicable subscription fees. Fees are billed in advance and are non-refundable except as expressly provided in these Terms.

6.2 Payment Processing

Payments collected through the Service are processed via Stripe (Stripe privacy policy). You acknowledge and agree to Stripe's terms of service and privacy policy. Transaction fees may apply.

6.3 Late Payments

Failure to pay subscription fees may result in service suspension or termination. Past due accounts may be subject to interest charges and collection efforts.

7. Intellectual Property Rights

GoClaim Agent and all related software, algorithms, content, and materials are the exclusive property of the Company and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain ownership of data you input into the Service, but grant us a license to use such data to provide the Service and improve our algorithms.

8. Service Availability and Modifications

8.1 Service Availability

While we strive to maintain continuous service availability, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

8.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes when possible.

9. Limitation of Liability

To the maximum extent permitted by law, GoClaim Agent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of your use of the service.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless GoClaim Agent, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your debt collection activities conducted through the Service

11. Termination

11.1 Termination by You

You may terminate your account at any time by providing written notice. Termination does not relieve you of any outstanding payment obligations.

11.2 Termination by Us

We may terminate your access to the Service immediately if you violate these Terms or engage in illegal activities. Upon termination, your right to use the Service ceases immediately.

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of France jurisdiction, without regard to conflict of law principles.

12.2 Arbitration

Replace the text by: Any dispute, controversy or claim arising out of or relating to these Terms, including their formation, validity, binding effect, interpretation, performance, breach or termination, shall be finally settled by arbitration under the Rules of the Centre de Médiation et d’Arbitrage de Paris (CMAP) by one or more arbitrators appointed in accordance with those rules. The seat of arbitration shall be Paris, France, the language shall be [French/English], and French law shall apply. Businesses may also use the European Commission’s Online Dispute Resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr.

13. Miscellaneous

13.1 Entire Agreement

These Terms constitute the entire agreement between you and GoClaim Agent regarding the Service and supersede all prior agreements.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

13.3 Assignment

You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

13.4 Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control.

14. Electronic Communications and Marketing Consent

In accordance with applicable privacy and communication laws, GoClaim Agent informs you of our intention to send communications via email or other equivalent electronic means.

Such communications may include, but are not limited to:

  • Training Content: Educational materials related to debt collection best practices, platform tutorials, and feature updates
  • Performance Reports: Updates, analytics, and insights related to your collection activities and industry trends
  • Marketing Communications: Information about new features, services, promotional offers, and company updates

14.1 Consent and Opt-Out Rights

By accepting these Terms, you consent to receive the communications described above. You may withdraw your consent at any time by:

  • Using the unsubscribe link provided in our emails
  • Contacting us directly at privacy@goclaim.ai
  • Adjusting your communication preferences in your account settings

Withdrawal of consent will not affect the legality of processing based on consent before its withdrawal. Essential service communications (billing, security alerts, legal notices) will continue regardless of your marketing preferences.

15. Support and Incident Resolution

15.1 Customer Support Commitment

GoClaim Agent is committed to providing timely and effective customer support:

  • Response Time: We undertake to respond to all customer inquiries and incident reports within three (3) business days of receipt
  • Resolution Timeline: We will provide a resolution to any reported incident within no more than two (2) months from the initial report

15.2 Incident Reporting Procedure

For resolution of incidents related to the provision of Services, GoClaim Agent provides the following support channels:

  1. Primary Contact: Send detailed incident reports to legal@goclaim.ai
  2. Required Information: Include your account details, description of the issue, and any relevant error messages or screenshots
  3. Escalation Process: If initial resolution attempts are unsuccessful, incidents will be escalated to senior technical staff

We will acknowledge receipt of your incident report and provide regular updates on resolution progress.

16. Updates to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
